(AP) ? It's Mitt Romney's show. But New Jersey Gov. Chris Christie rocked the house. Florida Sen. Marco Rubio was the talk of the town. And Wisconsin Rep. Paul Ryan's rising-star status was blinding as he accepted the party's vice presidential nomination.

"We can get this country working again. We can get this economy growing again. We can make the safety net safe again. We can do this," Ryan told cheering delegates at the GOP convention Wednesday night. "Whatever your political party, let's come together for the sake of our country. Join Mitt Romney and me."

Amid the applause for Ryan was the sound of the future. The Republican Party's next-generation leaders were in ample supply at the GOP's convention as they positioned for national roles and, perhaps, even their own shot at the White House in four or eight years.

After victories at all levels of government in the past few years, the GOP has a deep bench of up-and-coming governors, senators and, it seems, even House candidates. It's diverse, too, for a party that faces serious demographic challenges ? particularly among Hispanics ? in a country that's becoming more multicultural by the day.

"Growing up, I never imagined a girl from a border town could one day become a governor. But this is America," said New Mexico Gov. Susana Martinez, the nation's first Latina governor.

Condoleezza Rice, the first black female secretary of state, reminded delegates that she had grown up in the segregated South. "My parents taught me to never give up," she said, "and to always believe that my future could be whatever I dreamt it to be."

It's little wonder, then, that next-generation Republicans got plum slots behind the convention podium.

"In 2020, someone that you see speaking in a prominent role today is probably going to be on the ballot," said Lew Oliver, a Florida delegate from Orlando.

The Republican marquee represents "the emerging faces of the conservative cause," said former Florida Gov. Jeb Bush, a potential future presidential candidate ? like many others in attendance. He made the comment this week as he sat between Martinez and another first-term governor, Brian Sandoval of Nevada. Both are Hispanic, and talked about often in GOP circles as the future of the party.

Should Romney win in November, Ryan automatically would be considered the next leading prospect for the GOP nomination. Other Republicans on the rise could find themselves in the new administration. Some could end up being key political allies in presidential battleground states. And others could emerge as intellectual leaders within the party.

A Romney loss this fall to President Barack Obama would ? perhaps as soon as the day after the election ? set off a mad scramble among countless Republicans to emerge as the next presidential nominee.

Among those considered likely to weigh a run:

?Ryan, the Wisconsin congressman and federal budget specialist who will have had one national political campaign under his belt. His relative youth may serve as a bridge between generations, as he noted in his speech when he wryly compared his iPod playlist to Romney's: "I hope it's not a deal-breaker, Mitt, but my playlist starts with AC/DC and ends with Zeppelin."

?Christie, the New Jersey governor, who delivered a rousing keynote address Tuesday night and last year decided against a 2012 run.

?Bush, the oldest son of President George H.W. Bush and brother of President George W. Bush, who has long rejected overtures to run.

?Rubio, the Florida senator and Cuban-American who has spent the past year working to boost his national political profile.

There are countless others talked about ? and they, too, were on hand.

New Hampshire Sen. Kelly Ayotte, South Dakota Sen. John Thune and Virginia Gov. Bob McDonnell all received polite receptions. Rice, a party favorite, was buzzed about as she sat in the Romney family's private box and later addressed the delegates.

Wisconsin Gov. Scott Walker, who gained national attention for his fight against his state's public employee unions and for defeating a recall effort, delivered a robust speech in which he said that Romney, like himself, understands that "people, not the government, create jobs."

"Now, more than ever, we need reformers ... leaders who think more about the next generation than just the next election," Walker said. "That's what you get from Mitt Romney and Paul Ryan."

Christie's blunt, brash personality was on display during his keynote address as he implored: "Everybody stand up. There's no time left to waste."

South Carolina Gov. Nikki Haley, an Indian-American, drew hearty applause when she criticized Obama's challenge to her state's new immigration law. It requires police who have stopped someone for unrelated issues to report it if they suspect the person is in the country illegally.

"If this president refuses to protect our borders, refuses to protect our citizens from the dangers of illegal immigration, then states have to take it upon ourselves," she said.

Rubio was slated to introduce Romney on Thursday and gave a preview of his speech while at a salsa concert Monday night.

"There's no community that understands how to grow an economy faster than Americans of Hispanic descent," Rubio said. "We're as entrepreneurial, as hardworking as any people in this country and at the end of the week it will be clear to all of America that there's only one person running for president that understands what it takes to grow the economy and that's Mitt Romney."

The deep roster excites rank-and-file Republicans about the future.

"I see wins, wins, wins," said Denise Graves, a delegate from Linden, Mich.

Allen Alley, chairman of the Oregon Republican Party, said he was excited about hearing some of the new GOP stars that he hadn't seen before, saying, "The country will be introduced to a Republican Party that they have not been aware of."

Small Business Owners Brace for Hurricane Isaac | Best ...

All entrepreneurs must have a comprehensive disaster recovery plan and a good insurance policy. Here?s how to get started.

Hurricane Isaac from Space

NASA

NASA?s Terra satellite captured this image of Tropical Storm Isaac on Aug. 28 as it was moving northwest through the Gulf of Mexico.

As Hurricane Isaac beats down on the Gulf Coast, businesses are on high alert, preparing to take the brunt of the storm.

Many small businesses?but perhaps not enough?have already braced themselves?for a worst-case scenario.?The two most critical components of small business disaster survival, they?ve found, are a comprehensive backup of business data and systems, and an insurance policy that will allow them to rebuild if a business is decimated.

Louisiana small businesses are making use of the newly-created Louisiana Business Emergency Operations Center, which aims to create business stability during crises, and to help state businesses plan ahead for emergencies.

?The state government has done a good job making sure small business owners are better-prepared since Katrina,? says Renee Amar, the state director for Louisiana for the National Federation of Independent Business Owners.

Still, half of all small businesses don?t have a disaster recovery plan, according to a 2011 survey conducted by security firm Symantec. What?s more, 43% of businesses that close following a natural disaster don?t reopen, and 29% close two years later, according to federal data.

Backup Backup Backup

?Whenever large disasters, or newsworthy hurricanes like Katrina or major earthquakes hit, it serves as a wake-up notice for businesses of all size to address backup and disaster recovery processes,? says Frank Scavo, president of IT consulting firm Computer Economics, in Irvine, California.

Computer networks and telephone systems are the lifeblood of any enterprise and small business owners can?t afford to be without them for long.

Entrepreneurs have to make sure they back up data and systems application information locally every day, and at least once a week in another location.?

There are more low-cost or no-cost small business backup options than ever before.?Plenty of affordable cloud services exist today to help move critical network operations and data to remote locations. The most prominent is Amazon?s S3 service, which allows businesses to offload data to Amazon?s server farms around the country.? Businesses with smaller file requirements can use free or low-cost options from Dropbox, Box.net, or Microsoft?s Skydrive.

?An ideal situation is if you run an accounting system in the cloud and disaster affects your primary location, you can continue to access this from any place,? Scavo says. Scavo adds other benefits of using the cloud for storage and backup is that most of the paid services, in addition to being co-located themselves, also have IT help desks.

In a disaster, small business owners need a plan to locate IT staff to resolve technology problems, Scavo says. That can be a real problem if a hurricane or other natural event displaces people.

Lou Rossi, chief executive of Qoncert, an IT-services firm with 30 employees in Tampa, Florida, which was also in the hurricane?s wake. In charge of the No. 209 on the Inc. 500 list this year, Qoncert regularly counsels other small business owners on disaster recovery plans?and also follows his own advice.

The company?s phone and computer network is centered in Winterhaven, about 50 miles inland from Tampa. Its data center is housed on one of the highest spots in the state, to resist flooding, and the storage building itself can withstand a category 4 hurricane. (Category 5 hurricanes rarely make it that far inland, Rossi says.)?Qoncert backs up critical files using files storage service Egnyte, and outsources accounting and customer relationship management to Netsuite.

?If Tampa were to disappear off the face of the earth, we could still be talking in St. Augustine, Florida,? Rossi says.

Disaster Insurance Is Trickier, But Imperative

Insurance is more complicated, and businesses have to be careful as they proceed with a plan. It?s difficult to get one comprehensive policy. Instead, most businesses must cobble together multiple policies, which requires both time and money. After employee costs, insurance is one of the most costly items for any small business owner.

A standard business owner?s policy should cost around $1,000 annually, and covers some basics like liability, business property, and loss of income due to a disaster. ?But private insurers in coastal areas won?t cover for floods or wind damage.?You?ll have to insure separately for that, and if your business is based out of your home, you?ll have to get some business coverage that?s different from your residential plan.

Most coastal states partner with federal or state governments to insure for wind and flood damage. In Florida, for example, residents can turn to the state?s Citizens Property Insurance Corporation for wind damage insurance. Similarly, coastal residents can turn to the federal National Flood Insurance Program (NFIP) for coverage. Both types of insurance can add thousands more to your yearly insurance costs.

But there are limits to the federal insurance, of about $500,000 for damage to structure and $500,000 for damages to property inside the structure, says James J. Whittle, Assistant General Counsel & Chief Claims Counsel, for the American Insurance Association.

To get extended coverage, you?ll have to circle back with your private insurer, many of which do provide supplemental flood insurance. ? ? ? ? ??

?[Private insurers] are willing to retain more of the risk when you have federal NFIP coverage in place,? Whittle says.

Erin Mitchell, founder and owner of Hew Communications, in St. Petersburg, Florida, says having a disaster recovery plan in place is a big job, but essential.

A sole proprietor, Mitchell operates out of a home office. Her residential insurance, purchased through CPIC, includes coverage for wind damage and damage to property inside the house. She purchased a separate business liability plan with a premium of about $2,000 that covers $1 million in damages. She?s forgone flood insurance, because her home is on a hill and a mile away from the beach, she says.

Mitchell has also equipped her house with power packs that can charge off her car engine, three cell phones from three different telecommunications carriers to make sure she can always be in touch with clients, and she has begun to offload things like her accounting and CRM functions to software as a service providers XERO and NetSuite respectively.

She adds: ?When you run a business from your home you have to know exactly what you are doing.?

Thousands of Canada teachers protest pay freeze

Canadian teachers on Tuesday protested proposals for a two-year pay freeze and curbs to their collective bargaining rights to help pay down Ontario province's $14.8 billion budget deficit.

Waving placards that read "Stop bullying me," an estimated 5,000 teachers gathered outside of the Ontario legislature, accusing Liberal Premier Dalton McGuinty of "betraying" them, live television showed.

Public broadcaster CBC said the demonstrators were joined by peers from across Canada in a massive show of solidarity, while thousands of students in neighboring Quebec province continued raging against tuition hikes.

McGuinty won elections in 2003, 2007 and last October with the support of teachers.

But more recently he has said the province cannot afford teacher pay hikes and their banking of unused sick days that would cost the province $473 million.

His minority government has put forward a controversial emergency bill to freeze pay as well as ban strikes for two years.

The bill is expected to pass next week, as students return to classes, with the support of the Conservatives who want the wage freeze extended to all public sector workers.

Egypt leader said to reach out to Sinai radicals

CAIRO (AP) ? Egypt's Islamist president is using former jihadists to mediate with radical Islamists in Sinai, trying to ensure a halt in militant attacks in return for a stop in a military offensive in the lawless peninsula, participants in the talks say.

The move marks a dramatic change from the iron fist policy of heavy crackdowns and waves of arrests under ousted leader Hosni Mubarak, which critics say only fueled support for militancy among Sinai's Bedouin population by subjecting them to torture and other abuses. But the dialogue and any possible truce could raise concerns in neighboring Israel, which has been targeted in cross-border militant attacks and has urged Egypt to stamp out the groups.

The dialogue also raised concerns among some in Egypt that it would give a de facto recognition to some of the most hard-core, fringe Islamist movements, which have gained followers in Sinai and in other parts of the country. The mediation attempt shows a willingness by President Mohammed Morsi, the Muslim Brotherhood figure who became Egypt's first freely elected leader, to use his Islamist credentials to deal with such groups in hopes of keeping them away from violence.

Egypt's military launched a major military operation in the Sinai after suspected Islamic militants carried out a surprise ambush of Egyptian troops on the border with Israel and Gaza on Aug. 5, killing 16 soldiers, before driving into Israel in an apparent attempt to carry out an attack. There, they were stopped and killed by Israeli airstrikes. Since the ambush, thousands of troops backed by tanks and heavy equipment have been deployed in northern Sinai, near the Israeli border.

The attack stunned the military and government and raised alarm over militants who had grown more powerful amid the collapse of central authority in Sinai after the fall of Mubarak. Over the past year and a half, attacks on police stations by armed men raising black banners similar to al-Qaida-linked groups became frequent, and militants ? flush with weapons smuggled in from Libya ? carried out attacks on security forces and several attacks into Israel, reportedly with the help from extremists in neighboring Gaza.

Still, the military operation seems to have avoided direct confrontations, apparently to avoid enflaming tensions with the population.

There were several raids on alleged militant hideouts in the first few days, but none reported since. Instead, the troops appear to mainly be making a show of force, setting up checkpoints on main roads and around the main towns of northern Sinai. In one instance, security officials said they notified the military of a meeting of wanted militants in the north Sinai town of Sheikh Zuwayid, but orders came to let them go without intervention.

At the same time, the past week has largely seen a halt in the hit-and-run gun attacks by suspected militants on police and army checkpoints that were frequent early in the operation.

Over the weekend, the first sessions of the dialogue took place between Sinai Islamists and a delegation of reformed jihadist mediators that participants and security officials in Sinai said was sent by Morsi's office.

The president's spokesman, traveling with Morsi on a visit to China, could not be reached to confirm that Morsi sent the mediators. The independent newspaper El-Shorouk quoted officials in Morsi's office as confirming that the delegation went to Sinai in vehicles with presidential license plates but that no officials from Morsi's staff were in the delegation.

Israeli military officials said they were not aware of the dialogue and refused to comment.

The idea appeared to be that such former jihadists ? who once waged bloody campaigns against the government but have since forsworn violence ? would have credibility with the Sinai militants to convince them to halt attacks.

In the talks, the two sides reached an agreement that would "pacify the situation forever," Hamdeen Salman Saad, a prominent Sinai Islamist who participated in the meetings, told The Associated Press.

Under the arrangement, Egyptian troops and security forces would not attack Sinai Jihadists and, in return, there will be no counterattacks or more bloodshed, he said. They would also stop "infiltrators" who aimed to carry out "sabotage" in Egypt, he said, referring to radicals coming from outside Sinai.

Another participant in the meeting said that under the arrangement, weapons would be handed over. On Sunday, a tribe called el-Barahma handed anti-aircraft guns, machine guns and large amount of ammunition to the military.

The participant also said Egypt would fully open the Rafah crossing into the Gaza Strip, while destroying part of the underground tunnel network used in smuggling, along with goods and medicine, weapons and militants to and from Gaza. The participant spoke on condition of anonymity to discuss specific details.

Saad and several other participants depicted the arrangement as agreed to by the delegation of mediators.

That did not necessarily mean Morsi has signed on to the details.

Morsi's spokesman, Yasser Ali, said late last week that the Sinai offensive was continuing and was succeeding in establishing security in the area.

The military Chief of Staff Sedki Sobhi, appointed by Morsi earlier this month, vowed that the army will not let the blood of the soldiers slain in the Aug. 5 attack "go in vain."

"The armed forces will not permit any criminal hideouts in the land of Sinai, and current measures taken ensure that no innocent will be harmed," he said. He said the military forces do not aim to "counter thoughts with weapons, but they raise arms in the face of those who carry arms."

The dialogue suggested continuing distrust between Morsi and internal security forces, which under Mubarak carried out heavy crackdowns on the Brotherhood. The security officials in Sinai said they had no prior knowledge of the mediation effort and discovered it only when the delegation arrived in Sinai and visited what they called some of the main strongholds of Islamic radicals in the towns of Rafah and Sheikh Zuwayid.

The delegation was led by a former jihadist leader, Magdi Salem, who served 18 years in prison for being part of a militant group known as the Vanguards of Conquest that carried out attacks in Egypt in the 1990s, including attempted assassinations of the prime minister and other officials. Also in the delegation were other former Islamic militants and a prominent lawyer from the ultraconservative Salafi movement, Nizar Ghorab, according to participants in their meetings and security officials in Sinai.

They met with around 40 prominent figures from Sinai hardline Islamist movements, according to one participant in the talks, who spoke on condition of anonymity. The figures deny having any connection to armed militants who carried out the Aug. 5 attack or other attacks the past year against security forces. But they have influence over Bedouin youth who may join those groups.

Safwat Abdel-Ghani, a former jihadi who helped set up the meetings, said the dialogue aimed to "prevent escalation or expansion of the conflict as it used to happen in the past." Previously, security forces would launch heavy-handed crackdowns after any militant attack, arresting droves of Bedouin who already complain of neglect and discrimination by the central government.

"You would have 60 involved in one attack, but because of the repressive policies, you end up with confronting 600," Abdel-Ghani said.

Ahmed el-Jehaini, a leading Sinai Salafi who met with the mediators, praised Morsi for "reaching out to the sons of Sinai to build confidence."

Khalil Anani, an analyst of Islamic movements, said that a security crackdown in Sinai is not a solution, but that the dialogue strategy is also risky.

"On one hand, Morsi's reaching out to the jihadists can create divisions within their circles and weaken them, but on the other hand it is dangerous that you recognize the Jihadi groups," he said. "It is also very risky game that could fire back as Morsi could be using them but later on they can turn against him."

China Construction Bank 1H profit up 14 percent

HONG KONG (AP) ? China Construction Bank, one of China's four major state-owned lenders, has posted the slowest first-half profit growth since 2009 amid government interest rate reforms and slowing economic growth.

The bank said late Sunday profit rose 14.5 percent to 106.28 billion yuan ($16.7 billion), or 0.43 yuan (7 U.S. cents) per share. That's down sharply from a year ago, when net income grew 31 percent.

Interest income rose 16.5 percent to 169.7 billion yuan ($49.1 billion).

China Construction Bank said there are still "many challenges" for the global recovery in the second half of 2012. The bank said it does not expect authorities to change any policies on restrictions to mortgages and lending.

It also expects recent relaxations on deposit and lending rates to result in more "intensive competition" among banks.

Best Buy will open books to founder Schulze

Brendan Mcdermid / REUTERS

Best Buy has agreed to open its books to its founder and former chairman Richard Schulze.

By Roland Jones, NBC News

Best Buy said Monday it has agreed to open its books to its founder and former chairman Richard Schulze, allowing him to potentially set up a deal to take the struggling electronics retailer private in a deal worth some $8 billion.

The news pushed Best Buy?s share price up 4.1 percent to $18 Monday.

Schulze -- Best Buy?s largest shareholder, controlling 20.1 percent of the company?s shares -- is offering to buy all the outstanding shares of Best Buy (BBY) he does not already own for $24 to $26 per share in cash.

He has sought the board?s permission to conduct due diligence on the company and put together a consortium that includes other executives and private-equity investors to make an offer for the retailer.

Now that permission has been granted, Schulze has 60 days after starting due diligence to propose a fully financed bid for the company. He also gets two board seats to represent his stake.

Best Buy has struggled in recent quarters as customers have migrated to Apple and online retailers such as Amazon.com.

In a statement earlier this month Schulze said ?immediate and substantial changes are needed? for Best Buy to ?return to its market-leading ways.?

Schulze stepped down from the company earlier this year after an internal probe found he failed to tell the retailer?s board about allegations that former chief executive Brian Dunn was having an inappropriate relationship with a 29-year-old female subordinate.

Dunn, who resigned in April, ?violated company policy by engaging in an extremely close personal relationship with a female employee that negatively impacted the work environment,? according to an internal investigation by the retailer?s audit committee.

Reuters contributed to this report.

Jeff Tomasulo, Belpointe, and Anthony Chukumba, BB&T Capital Markets, discuss whether now is the time to buy Best Buy stock.

Jobslover could be the Only Actual Source for On the web Paid ...

With over 500 ?paid survey? businesses online, it is clear that this is a company that is here to remain. A few of the sites supply you an chance to ?get wealthy quick? even though other individuals supply you a likelihood to earn several additional dollars inside your spare time participating in panels. Are you able to make a living off of those internet sites You confident can ? but not by taking surveys. There basically isn?t sufficient time in each day to earn a viable living off of the on the web survey gig.

So how are you able to make real income with these internet sites

It?s extremely straightforward. You generate a ?survey portal.? Although not simple to setup, as soon as established, it is a way it is possible to earn funds and not even must fill out a single survey. The set-up costs are minimal, but some computer information is expected.

Many of the online survey companies supply a ?referral? fee for directing these who wish to earn cash by taking surveys to their site. And this really is exactly where the money is.

The very first thing you have to do is acquire a domain name. You may wish to get 1 that is catchy and simple to keep in mind too as spell. As soon as our domain name is secured, you?ll need to set up a website. It doesn?t must be elaborate at all, but must be attractive towards the viewer. And, naturally, you are going to need to have a host. Most host businesses charge about $25 a month. You want to ensure you obtain a host that permits ads. Some hosting sites like Yahoo are very user friendly, but do not allow advertising.

You will need to do a bit of study in to the several survey businesses that provide a referral fee. You?ll be able to sign up for every web site and you?ll get a ?referral link.? This link will be posted in your website in the form of a ?hyperlink.? You will want to get as several referral links as you?ll be able to to post in your site. When researching the firms, make sure that referral payments are produced in money, not points, and that you could get them by check or through Paypal. Should you choose to accept those that provide points, you are going to must monitor that internet site to ensure you cash in the points for cash periodically. Don?t bother with any site that offers points in exchange for sweepstakes entries or prizes; you are wasting your time.

Some survey web sites offer ?affiliate? programs. This really is where you are able to actually post an marketing banner on your internet site. It will not price you any money, and each and every time somebody actually clicks on the banner and signs up for the survey business, you are going to get paid.

You will wish to use a lot of visual effects in your site providing the impression that anyone can make a living on the internet undertaking surveys. I?ve noticed a lot of survey portals, numerous of them have pictures of big homes, pools, exotic vacation spots and fancy vehicles. Be careful that you just do not use any pictures topic to copyright.

It is possible to also add some ?testimonials? to your portal website. You?ve to become cautious not to deliberately mislead people; but an ambiguous statement for example ?I was working 56 hours per week at a dead end job and now earn more than $10,000 a month ? Brenda K.? will not be illegal. Because you?re not directly saying that carrying out surveys may be the cause Brenda K. is now earning $10,000 a month. Brenda K. could have won the lottery and is taking her winnings inside a monthly payout.

Furthermore to getting several hyperlinks directing individuals for the survey websites for which you will obtain a referral fee, you?ll be able to also add other marketing on your internet site. You?ll find several firms that supply pennies on the dollar each time an individual clicks on their ad that is in your internet site. This can be just yet another approach to create income for the survey portal site.

Probably the most crucial factor you should discover how you can do is market place your web site. Furthermore to hundreds of paid on the internet survey internet sites, you can find also hundreds of free blogging web sites. Sign up for them, make as many ?friends? as you can and tout the success of one?s on-line enterprise daily in your blog (offering a link to your site, obviously),

Although this method of creating cash may be just this side in the law and requires a little of time, a modest initial money investment and periodic updates, this can be the only approach to generate income in the on the internet surveys for money game. PT Barnum knew it; other men and women know it and now you do, as well. There is certainly a sucker born every single minute.

Just make certain the ?sucker? is not you.

The Best Essential Appliances for Bakers

It is of great importance for those who earn the living of the bakery to invest in quality; otherwise articles will lose lots of money buying equipment that does not last long and are all their savings in maintenance and repairs.

These lost funds could be used to buy ingredients, pay the rent or other important things. Although breads, cakes and cakes can be made by hand, you can save more time if you buy equipment and electrical appliances and so double or triple production.

Mixer

Bakers need excellent mixers and some of the best brands. A mixer can have great influence on the consistency and increased mass or mixture as a dough cake and icing. This is an important part in the kitchen of a Baker and you should definitely be high quality and brand of confidence such as those mentioned previously.

Job woes stifle Tampa's real estate recovery | Armonk NY Homes ...

Last year a reporter for an online news service asked me, ?Which beaten-up market will come back quicker and stronger?? One of my responses was ?Tampa, Florida.?

What I appreciated about Tampa was that unlike most other Florida metros, all of which were equally crunched during the Great Recession, this Gulf of Mexico port city boasted a diversified economy and less reliance on the low-paying tourist industry.

It was a counterintuitive call because earlier in the year, an S&P/Case-Shiller report listed Tampa as one of only nine cities in the country where prices were still at the lowest levels since the onset of the recession, meaning home prices had fallen even further than the lows set in spring 2009.

Indeed, 2011 wasn?t a good year for the Tampa housing market. The average sale price, which had a peak of $264,606 in December 2007, according to data from the Greater Tampa Association of Realtors (GTAR), fell all the way to a low point of $150,103 in February 2010. Then in January 2011, a new low was reached at $134,856, before the market bounced back.

So, did that mean I guessed wrong? Not necessarily. At best I could say my optimism about Tampa was just a bit premature, because 2012 has begun to look like a comeback year for the city and the state.

Sunshine has returned to Florida and to its real estate markets. Florida and Tampa are going through a ?mini-recovery,? declared John Tuccillo, chief economist for Florida Realtors.

According to Sally McFolling, GTAR president and director of sales and marketing at Homes by WestBay in Lithia, Fla., home prices in the Tampa metro have been rising all year. The data supports McFolling?s assertions. In January, average sale price stood at $143,940; then in the most recent numbers (from May) prices had risen monthly to hit $170,698, a substantial movement!

So, is the city in recovery mode?

I checked in with Stanley Geberer, an economist and senior associate with Fishkind & Associates Inc., an Orlando-based economic consulting firm. Geberer gave me a brief history of Tampa?s housing woes.

The metro generally includes Tampa in Hillsborough County; the sister city of St. Petersburg in Pinellas County; and various suburbs in other counties.

?St. Petersburg is an older city, and Pinellas County is technically built out,? Geberer said. ?To the north of Hillsborough is Pasco County, home to Tampa?s bedroom communities, which was highly overbuilt and overpermitted. Many tens of thousands of vacant lots were approved for construction and the inventory of vacant lots is very high. In Hillsborough, the inventory of vacant lots approved was not as high as in Pasco.?

Here?s the problem, Geberer said: ?The volume of residential units that were built at high prices and sold at high prices are now underwater. In terms of discontinuity, it created about 100,000 foreclosures since 2009. For 2012, we expect 15,000 to 16,000 new foreclosures and 10,000 more in 2013.?

Geberer is not so enthusiastic about Florida?s mini-recovery. ?Generally, single-family home prices declined throughout Florida in 2011 and at least through the first quarter of 2012. Depending on what market you are in, prices have continued to slip or flatten out. There are no markets in the state seeing robust price increases.?

To which he added, ?Florida is lagging the recovery in the rest of the nation because it is a very growth-dependent state, meaning it is dependent on the construction industry, which has been devastated. Secondly, since we are growth-dependent we are host to a lot of migrating residents, people who move down from the north. But, they can?t move down here until they sell their homes up north.?

The solution to the recovery, said Geberer, is for the state to generate new jobs. Easier said than done.

In Tampa, Geberer said, the metro of almost 3 million people generated 36,000 jobs in 2011 and expects another 32,000 in 2012. Good, but not great.

?Tampa?s unemployment rate is about 8.2 percent, which sits under the state?s unemployment rate of 8.4 percent,? McFolling said. ?It?s nothing to get excited about, but we have seen companies move in, financial firms expanding and the military base (MacDill Air Force Base) generating jobs.?

If employment and job creation are the keys, then there are still concerns about Tampa.

Lesley Deutch, a vice president with John Burns Real Estate Consulting, recently issued a report titled, ?Florida?s Housing Market Is Booming, But Will It Last,? in which she writes: ?Every month, we analyze a litany of statistics for our research clients, and we have been pointing out a disturbing trend. Florida?s employment growth is slowing.

?Florida currently has the slowest year-over-year payroll employment growth of any region in the nation. Of the 20 metropolitan areas in Florida we analyze, 12 of them are now experiencing year-over-year job losses. While the larger metropolitan areas (Tampa, Orlando, Miami and Jacksonville) are still experiencing year-over-year job gains, the pace is slowing.?

According to John Burns? research, in November 2010, Tampa employment growth was about 10,000 annually. That rose to about 40,000 at the end of last year. By the start of the second quarter this year, the numbers dropped back down to the 25,000 range.

Nevertheless, McFolling remains optimistic. Taking a look at Tampa?s real estate market, she is very encouraged by the inventory picture. Back in 2007, inventory rose to almost 25 months.

In May 2012, that number had dropped all the way down to 3.7 months. Of that, about 28 percent or 29 percent are REOs and short sales, McFolling said. Back in that difficult year of 2007, almost 22,000 homes were in inventory. That number has declined to 7,770 homes.

Although, new home building has picked up in Tampa, Geberer expects the city?s continued but moderate job formation pace will help clear residential inventory. Still, he said, ?Prices will remain flat until inventory will be worked through.?

Or as Deutch cautioned, ?Monitor the Florida economy carefully if you are investing there!?

Twitter's Trademark Infringement Problem - Traverse Legal - Typepad

You may have heard that users have registered trademark terms on Twitter, and have also impersonated celebrities or other brand names. This is a consistent and ongoing problem for Twitter. The bigger problem, however, is Twitter's statement with regards to liability and their simple process that is required to be undertaken if, in fact, you want to have a trademark infringer or an impersonator removed from their service.

Well, what are these problems? Twitter first requires that any complaint, whether trademark or otherwise, be submitted from the domain name of the complaining party. So, for example, if you are an attorney that represents a party that owns www.something.com, then the attorney must be granted an email address from www.something.com. This requires the client to provide their attorney with an email address.?

Welcome to Trademark Law Radio, a top web resource on issues of trademark infringement, trademark licensing, trademark protection, and trademark registration.?

Hello and thank you for listening to Traverse Legal Radio. My name is John Di Giacomo and I am an attorney with Traverse Legal PLC, where I practice in the areas of trademark infringement, copyright infringement, and other internet-based intellectual property matters. Today I'd like to talk to you about Twitter's ongoing trademark infringement problem.

This requires the client to provide their attorney with an email address.

Additionally, a second problem that Twitter currently has is that it does not recognize Common Law trademark rights. It only considers a trademark claim if the trademark is in fact registered.

Common Law trademark rights, as opposed to registered trademark rights, are rights that arise out of the use of a mark in commerce. After a longstanding use of a trademark in commerce, a person or a company may obtain trademark rights in a term within the geographical area in which it was used. These trademark rights are no less important or no less valid than those of a registered trademark. In fact, registration simply grants additional benefits to a Common Law user.

In light of these problems that Twitter has, it faces some pretty significant claims of liability and it's likely in the future Twitter will be sued if it does not, in fact, change its policies with regard to trademark infringement and brand impersonation. Why is this?

Well first, Twitter faces a claim of vicarious liability. Vicarious liability requires a finding that the defendant, in this case Twitter, and the infringer, in this case the user of a Twitter handle, exercise joint ownership or control over the infringing product. Since Twitter exercises ownership and control over the infringing product, it could be held vicariously liable because it has the ability to shut down the infringement.

Additionally, Twitter can be held liable for contributory trademark infringement. Contributory trademark infringement occurs where a party continues to supply a product or service to an infringer when it knows that that infringer is engaging in trademark infringement. In this case, again, Twitter continues to provide its service, the social networking service, to individuals that it knows that are infringing upon the third party's trademarks.

Once it has been put on notice, regardless of Twitter's policy, this duty to cease the infringing behavior applies, otherwise Twitter will be held liable for contributory infringement. These are just some of the ways in which Twitter faces some liability with regard to the way that it currently handles trademark infringement problems and brand impersonation problems.

If you have a brand impersonation or a trademark infringement problem with regard to Twitter, contact one of our attorneys today. Again, this is Traverse Legal Radio and I am an attorney, John Di Giacomo. Thank you and have a good day.

You have been listening to Trademark Law Radio.? Whether you are facing a trademark infringement, licensing, monitoring or trademark registration issue, we have a trademark attorney ready to answer your questions.? ?

Ryan says Obama undercuts welfare reform law

SPRINGFIELD, Mo. (AP) ? Republican vice presidential candidate Paul Ryan says President Barack Obama wants to ease work requirements for welfare recipients even though that claim has been largely debunked by independent fact checkers.

Ryan told donors at a $1.2 million fundraiser in Missouri on Thursday that Obama wants to strip the work requirements from the welfare reform law. Ryan says it showed the president wants to promote dependency on government as a solution to economic woes.

The Obama administration, responding to requests from Republican and Democratic governors, is allowing states to apply for a waiver seeking flexibility in how to administer the welfare work requirement in their states. Mitt Romney's presidential campaign has seized on that in recent weeks, saying Obama undercut the welfare reform law signed by President Bill Clinton in 1996.

Iowans head to Florida to face Hurricane Isaac

MARION, Iowa ?

Nine Iowans with the American Red Cross will leave Friday for Tampa, Florida, as Hurricane Isaac is expect to hit next week, KCRG-TV reported.

Forecasters said Tropical Storm Isaac probably won't be tagged a hurricane until Monday, when it reaches the Gulf of Mexico.

Volunteer Linda Sutherland, of Marion, packed her bags Thursday night not knowing yet where she will be in a few days.

"We leave home, not sure where we will end up, we just know we will be in a safe Red Cross environment," she told KCRG-TV.?

The U.S. National Hurricane Center said the latest five-day forecast shows the storm shifting to the west. That path would have it make landfall possibly near the Alabama-Mississippi border.

But Hurricane Center forecaster Eric Blake said it's too early to pinpoint the course, and he said Florida's Gulf Coast is still in the forecast area. That is worrying organizers of the Republican National Convention, which opens Monday in Tampa.

"I have to admit, I've never been in a hurricane so I am a little bit nervous about that part," Sutherland told KCRG-TV.

Watching disaster unfold on TV spurred Sutherland to volunteer.

"When 9/11 hit, I sat on the couch for a month and cried, I thought I am not a police man, I am not a fireman, I am not a nurse. How could I possibly be of value, same thing when Katrina happened," said Sutherland.

The trip to Florida will be Sutherland's seventh trip with the Red Cross.
