AP Exclusive: Calif. 9/11 fund raided for deficits

SACRAMENTO, Calif. (AP) ? After the 2001 terrorist attacks, California lawmakers sought a way to channel the patriotic fervor and use it to help victims' families and law enforcement. Their answer: specialty memorial license plates emblazoned with the words, "We Will Never Forget."

Part of the money raised through the sale of the plates was to fund scholarships for the children of California residents who perished in the attacks, while the majority ? 85 percent ? was to help fund anti-terrorism efforts.

But an Associated Press review of the $15 million collected since lawmakers approved the "California Memorial Scholarship Program" shows only a small fraction of the money went to scholarships. While 40 percent has funded anti-terror training programs, $3 million was raided by Gov. Jerry Brown and his predecessor, Arnold Schwarzenegger, to plug the state's budget deficit.

Millions more have been spent on budget items with little relation to direct threats of terrorism, including livestock diseases and workplace safety.

Moreover, the California Department of Motor Vehicles has been advertising the plates as helping the children of Sept. 11 victims even though the state stopped funding the scholarship program seven years ago. The specialty plate fund continues to take in $1.5 million a year.

Californians who lost loved ones in the attacks take the raid on the license plate fund as an affront to the memory of those who died.

"I can't believe that they would do that," said Candice Hoglan, who lives in the San Francisco Bay Area and bought a plate to commemorate her nephew, Mark Bingham. "We're paying extra for the plate; we're making a point, and it means a lot to us."

Bingham was killed on United Airlines Flight 93, which crashed in Pennsylvania, and was one of the passengers who led the attempt to wrest control from the hijackers. His mother, Alice Hoagland, also was troubled by the program's apparent drift from its original purpose.

"I'm sorry that as we retreat in time from 9/11, we seem to be retreating in our resolve never to forget," she said in a telephone interview.

The plates, which cost an initial $50 plus a $40 annual renewal fee, feature an American flag partially obscured by clouds and the "never forget" slogan. Residents of California, where all four jetliners were bound when they were hijacked, have bought or renewed the plates more than 200,000 times since 2002.

Of the other states directly associated with the 2001 attacks, only Virginia has established a similar specialty plate program. Yet it did not set up a special fund for the proceeds of its "Fight Terrorism" plate.

For the past decade, the California DMV has said on its website that the money will "fund scholarships for the children of Californians who died in the September 11, 2001, terror attacks and helps California's law enforcement fight threats of terrorism." It advertises the program with the slogan, "Be a patriot."

While the DMV description of the program was not "totally disingenuous," the department should probably remove references to the scholarship program, said Joe DeAnda, a spokesman for the state treasurer's office, which disburses the money.

"It's out of date and it's on DMV to update that," he said.

Late Friday, the department modified the description of the license plate on its website to remove the reference to the scholarship program in response to the investigation by the AP, which began in March. Spokeswoman Jan Mendoza said the reason promotional materials were not updated sooner was "unknown."

The DMV still lists the scholarship program on the online and hardcopy form drivers fill out to buy the license plates, but Mendoza said the department will change this next time the forms are printed.

The legislation establishing the plates had earmarked 15 percent of the revenue for scholarships. Yet only $21,381 has reached the children and spouses of the three dozen California residents killed during the terrorist attacks. The state treasurer's office closed the scholarship program in 2005, the sign-up deadline for potential recipients, and has $60,000 in reserve.

The total amount dedicated to scholarships was 1.5 percent of the $5.5 million raised through the sale of the plates through 2005.

The original legislation said the remainder of the money would go to "law enforcement, fire protection, and public health agencies" to be used "exclusively for purposes directly related to fighting terrorism."

But in 2008, former Gov. Arnold Schwarzenegger, a Republican, borrowed $2 million to close a budget gap. Last year, Brown, a Democrat, borrowed another $1 million.

Neither loan has been repaid nor are their deadlines to ensure they will be. Elizabeth Ashford, a spokeswoman for Brown, said the loans have done no harm.

"We're trying to simultaneously balance the budget and fund important programs," she said. "If there was an indication that borrowing this money was going to negatively impact this program, we wouldn't borrow the money."

The rest of the money has gone to a wide array of budgets and programs.

The Legislature sent $3.7 million to the California Department of Food and Agriculture, according to the Department of Finance, to establish an online food monitoring database and implement a variety of worker safety programs, including hiring industrial hygienists to tend to worker health.

But it is difficult to say precisely where the money has gone. Late Friday, the agriculture department delivered documents it said were in response to a California Public Records Act request the AP filed eight weeks earlier.

The response contained itemized budget reports going back six years and listing payments for all types of government functions, ranging from salaries and benefits, to printing costs and communication equipment. Among the details: $18,163 for furniture in 2006 and $11,492 for auto inspection in 2009.

The response also included a legislative report on the threats the agriculture department is targeting with an online database the license plate program helps fund . A similar report from 2006, when the license plate money was first authorized, lists bioterrorism as a potential danger. But the 2011 report focuses on food safety and livestock concerns, including foot-and-mouth disease and meat and poultry monitoring.

Director of Animal Health and Food Safety Services Annette Whiteford said the department does not track license plate money separately from other funds.

She said it would be wasteful to reserve the money exclusively for anti-terrorism work. For example, the department uses some of the money to buy safety suits that would be essential during an anthrax attack but also are useful for routine food investigations.

"The things that I worry about in the animal food safety division are very high consequence events, but very infrequent. So I always try to leverage those resources," she said.

Another $2 million has gone to programs that aim to protect Californians from all manner of potential threats, not just those related to terrorism.

The California Emergency Management Agency used nearly $1 million in memorial license plate money for general operations, including administrative costs, buying and fueling cars, and hiring a person from 2007 to 2009 to coordinate five so-called "fusion centers," according to documents obtained through a Public Records Act request.

The other $1 million went directly to the fusion centers, which were founded after the 2001 attacks to focus on terrorist threats but have since switched to an "all crimes" approach that includes gang activity and natural disasters.

Herb Wesson, who wrote the license plate bill when he was speaker of the California Assembly, said he was saddened to hear how the money had been spent.

"I understand the financial climate they find themselves in, but they are not following the spirit and intent of the legislation," said Wesson, now president of the Los Angeles City Council. "The lion's share of the money was supposed to be given to local law enforcement so that they could beef up their anti-terrorism operations."

About 40 percent of the total raised to date, or $6 million, has gone to anti-terrorism training programs for firefighters and law enforcement officers. There is a slight discrepancy between the DMV's revenue figures and the Department of Finance's expenditure figures that neither agency could explain.

Patricia Anderson, who paid $98 for a personalized memorial plate reading "WE R 4US," said she signed up for the program primarily to show respect for victims of the 9/11 attacks. Anderson said she was disheartened but not surprised to learn that much of the money has gone to fill the state deficit or used for general purposes.

"That's California," said Anderson, who now lives near Austin, Texas. "It's kind of a given these days ? nothing is spent on what it's supposed to be."

Redlands' Canales roars back to claim second in steeplechase at NCAA Championships

CLAREMONT - It was a finish that was all too fitting.

University of Redlands senior track and field standout Emily Canales capped off her career by turning on a late surge to finish second in the 3000-meter steeplechase final at the NCAA Championships meet on Saturday.

In front of a roaring crowd at Claremont-Mudd-Scripps' Burns Track Complex, the Bulldog star beat Rowan's Jena Peacock to the line, finishing with a program-record 10:36.62.

Canales rounded the final bend far behind top finisher Keri Lambert of Amherst College, and appeared to be locked in a battle for third, with field clinging to her heels and Peacock holding a healthy cushion. But Canales exploded down the final stretch, employing her signature last-minute kick to seemingly stun everyone but Redlands coach, Mike Schmidt.

Schmidt said the two had formulated a plan beforehand, and Canales executed it to perfection.

"Everything Emily does is smart," Schmidt said. "She eats smart, she trains smart, she recovers smart and you know what? Today she raced smart. That was exactly how we had it drawn up."

Canales, a Redlands East Valley graduate who'd never so much as made the CIF-Southern Section Prelims in her high school track and field career, said things changed when she got to the collegiate level.

She played catch-up in her two years at Vanguard and then poured everything she had into her pair of Redlands campaigns.

Canales knew that

capturing second with a late push in her final race was only appropriate. It was the culmination of four years of meticulous preparation.

"Just physically, I take care of myself obsessively," Canales said. "I've been sleeping a ton, I watch my diet, I've done everything I could to get to this point, and it all paid off."

Lambert, who cruised to a blistering 10:27.32, wasn't the only one who broke the track record of 10:37.60, as Canales and Peacock (10:37.20) also managed the feat.

To Canales, who was one of two Bulldogs to make the meet and the only one to appear in final, after Lambert and Peacock had darted ahead of the field early, it appeared that the two would fight for the top finish. But Lambert soon began to separate herself from Peacock, who seemed content to coast to second.

As the race wound down, Canales, who'd led the chase pack throughout, felt her legs start to wobble.

She was hoping to somehow just hold on to a trophy spot - and then, something inside stirred.

"I was so tired there at the end that I didn't know if I could hang on to my position," Canales said. "But I just said to myself, `This is it. This is nationals. It's now or never."'

Her goal heading into the day was just to capture a top-eight finish, which would secure her All-America honors. Clocking in with the fourth-fastest time of 1:49.91 and the fifth place overall at prelims, she was far ahead of that clip when she headed into her last 400 meters on Saturday.

But Canales still ran her last lap in 1:23.95, which was her fastest of the race.

Azarenka survives in 1st round of French Open

PARIS (AP) ? Top-ranked Victoria Azarenka survived a scare in the first round of the French Open.

The Australian Open champion, who took over the No. 1 ranking by winning in Melbourne, came back to beat Alberta Brianti of Italy 6-7 (6), 6-4, 6-2 Monday.

Brianti, a 32-year-old veteran who has won one WTA title in her career, won the first set and then led 4-0 in the second before losing six straight games.

Although Azarenka won 12 of the last 14 games, she struggled with her game throughout, committing 60 unforced errors.

Azarenka started the 2012 season with a 26-match winning streak. Her first loss came in the quarterfinals of the Sony Ericsson Open.

She is now 36-3.

Williams played at a major tournament for the first time since last August, when she withdrew before her second-round match at the U.S. Open. It was then that she revealed that she had been diagnosed with Sjogren's syndrome, a condition that can cause fatigue and joint pain.

It didn't slow her down in the last two sets Sunday. The seven-time Grand Slam champion recovered from a poor start and beat 19-year-old Paula Ormaechea of Argentina 4-6, 6-1, 6-3 to reach the second round.

"I just learned how to live with this. It's different. I have a lot to learn still," Williams said. "I learned how to just ? just learning. So I think that's my biggest challenge. I learn a lot every week, especially having to play a professional sport.

"So that's a challenge, just learning to live."

Williams was one of six major champions that advanced on the opening day of the clay-court tournament. The only one that lost was Andy Roddick, the 2003 U.S. Open winner.

On Monday, top-ranked Novak Djokovic and 16-time Grand Slam champion Roger Federer will be on court. In the women's draw, No. 1 Victoria Azarenka and defending champion Li Na are scheduled to play.

Williams was last up in the main stadium, Court Philippe Chatrier, and she didn't get off to a good start.

Although Williams is the one with the fast serve and the pounding groundstrokes, it was Ormaechea that was on the offensive. The strategy worked, for a while.

"She played super well the first set," Williams said. "I think she really did a lot of the right things, and I have to congratulate her on the first set, and thankfully the next two sets were better for me."

Chinese and Russian cooperation now crucial in ending the violence in Syria

When the UN Security Council voted last month to authorise a monitoring mission in Syria, it was a rare moment of unity and solidarity for the 15-member council. The outcome of the vote led to the deployment of approximately 300 UN monitors across five Syrian cities. Their sole mandate being, to apply all possible efforts to stop acts of violence, specifically targeted at civilians in the country.

However, early on Sunday, news broke that hundreds of villagers, including at least 32 children were killed in the village of El-Houleh, a Syrian town near the central city of Homs. The strong suggestion being that the government regime of Bashar al-Assad was responsible for the massacre. UN observers have reported that aside from the 32 children, monitors counted more than 60 dead adults, bringing the overall casualties to approximately 92 with more than 300 wounded. In response to these allegations, the Syrian government accused ?terrorists?, (its usual phrase for the opposition) of killing the civilians.

In a joint statement by the secretary general of the UN and the joint special envoy for Syria, condemned the brutal crime involving the indiscriminate and disproportionate use of force which is seen as a flagrant violation on international law and of the commitments that the Syrian government made to cease the use of heavy weapons on civilians.

The violence in El-Houleh has also been seen as the most flagrant violation of the UN and Arab League peace plan which was negotiated and brokered by former UN secretary general, Kofi Annan in April this year.

Since al-Assad?s government and opposition forces accepted Annan?s peace plan in March, at least 1?635 people have been killed. The events in El-Houleh are certain to call into question the continued effectiveness of the six-point peace plan going forward.

The reaction to the news of renewed bloodshed and loss of innocent civilian life has also taken on a sectarian undertone. Anti-Assad forces have said that much of the slaughter had been carried out by pro-government thugs referred to as ?shabiha?, from the surrounding area. El-Houleh is a Sunni Muslim town, while three villages around it are mostly Alawite and a fourth is Shi?ite Muslim.

Since the president and the core of his security services are also Alawites, an off-shoot of Shi?ite Islam, there has been renewed calls for sectarian revenge. This is a dangerous development as anti-government rebels are led by a majority of Sunni Muslims. The threat being that renewed tensions and conflict along sectarian lines could plunge Syria into further turmoil and also open the door for al-Qaeda?s involvement in the Syrian uprising.

The Free Syrian Army who are leading the revolt against the incumbent Syrian regime have stressed that the fight is for democracy, not sharia. However, if the situation on the ground remains the same this could potentially open the door for jihadists. Also given Syria?s geo-political strategic significance in the region, any further escalation in civil unrest and the infiltration of al-Qaeda could prove disastrous for long term stability in the region.

With the UN-Arab League six-point peace plan seemingly ineffective and current secretary general of the UN ? Ban Ki-moon ? admitting that the UN does not currently have a ?plan B? for Syria, the only realistic solution lies with the UN Security Council.

The 15-member council includes five permanent members (China,?France,?Russia, the?United Kingdom and the?United States of America) and? 10 elected non-permanent members (Azerbaijan, Columbia, Germany, Guatemala, India, Morocco, Pakistan, Portugal, Togo and South Africa).

In February, Russia and China vetoed a UN Security Council resolution that backed an Arab League plan to facilitate a political transition in Syria. Under?Article 27?of the?UN Charter, Security Council decisions on all substantive matters require the affirmative votes of nine members. A negative vote, or?veto, also known as the rule of ?great power?unanimity?, by a permanent member prevents adoption of a proposal, even if it has received the required number of affirmative votes.

The reasoning behind the Chinese and Russian veto vote on Syria was based on the principle that proposed action may further complicate events in Syria. In addition, that any move may put undue emphasis on pressuring the Syrian government, prejudge the result of the dialogue or impose any solution would not help resolve the Syrian issue.

Ostensibly Russian and Chinese concern also linger that the UN?s authorisation of all necessary measures to protect civilians was used to bring down Libyan leader Muammar Gaddafi?s regime. An outcome that the Russians and Chinese claim they do not want to see repeated in Syria.

More strategically for Russia however, is the fact that the Kremlin?s only military base outside the former Soviet Union is in Syria, and also sells weapons to al-Assad?s government. The only tangible solution being that al-Assad steps-down and a roadmap is put in place to hold elections in the coming 12 months. However, for this to happen there will need to be a unified vote in the Security Council which is scheduled to meet for an emergency sitting in the coming days.

Now more than ever is the time for the Security Council and the international community to be united in its response to Syria. But this will take decisive and unified action and resolve on behalf of China and Russia.
